Contractual partner
The sales contract is concluded with Vac-Star AG,
Rte de l'Industrie 7, CH-1786 Sugiez (called "Seller").

Ordering from the Vac-Star-Shop
Sending the order to the shop concludes a binding sales contract, insofar as this is confirmed by an official invoice from the seller.
The official invoice may differ from the invoice automatically generated in the seller's shop, if incorrect data have been supplied by the purchaser. (A reason for this may be that a mistake has been made in the selection of country or currency.)
Unless otherwise agreed in writing, the buyer's terms and conditions are repudiated.

Prices and shipping costs
There is a choice of various currencies in the shop.
For purchases in Switzerland, payment for orders is accepted only in CHF.
The prices published in the shop do not include VAT and shipping costs.
Price changes reserved!
If an incorrect VAT rate is calculated, where the domicile or country has been incorrectly entered, this shall be debited before the goods are dispatched.
The shipping costs are dependent on weight.

The minimum order value is CHF 20.00 (VAT and shipping costs not included in this amount).

For an order amount less than CHF 20.00, a surcharge will be applied.

Delivery
Delivery is worldwide.
On receipt of payment, articles, which are immediately available, shall be passed to our delivery service providers on the same or the following working day.

Delay in delivery

If the goods are not received by the buyer within the stated delivery period, the buyer must send a warning letter by registered post and set a period of grace of 30 days. On the expiry of this period of grace, the buyer may withdraw from the contract. However, this withdrawal shall only be valid, if the buyer has declared an intention to withdraw from the contract by registered letter. In the event of withdrawal from the contract, the buyer shall expressly waive any assertion of any claims and debts whatsoever arising from the failure to fulfill this contract.

Payment of first orders by new customers from Switzerland
Delivery shall be made to buyers, which place an order with the seller for the first time, only against payment in advance.

Monthly invoice with part payment option (PowerPay) 

With the monthly invoice (PowerPay) - the buyer can pay his online purchases easily by invoice with a part payment option. MF Group/PowerPay as an external payment service provider offers the payment method "payment via invoice". At the end of the payment process PowerPay takes over the resulting invoice requirement and handles the corresponding payment option. By selecting the monthly invoice, the buyer accepts the terms and conditions of PowerPay. (powerpay.ch/en/agb). 

 

Payment and delivery abroad
As a rule, delivery shall be made abroad only after receipt of payment.
Credit cards accepted: MasterCard, VISA.
All prices in the shop are exclusive of VAT and shipping. Deliveries to EU countries shall be invoiced at 19% VAT unless the buyer does not possess a VAT ID number. (Deliveries within Germany are always subject to 19% VAT).

Deliveries to countries outside the EU shall be free from VAT.
Delivery to EU countries is made, as a rule, from our dispatch warehouse in Germany.

Retention of title
The object of purchase shall remain the property of the seller until final payment of the purchase price, including all interest on arrears and costs, which may become due.
In accordance with Article 164 et seq. Swiss Code of Obligations, the seller or the creditor may assign a debt arising from this contract or the contract in its entirety to a third party without the consent of the buyer.

Liability
The seller shall be liable solely for intent and gross negligence.
Direct or indirect consequential damages, in particular, for loss of production, lost profit and other financial losses are excluded.

Place of jurisdiction
Applicable law is Swiss law and the place of jurisdiction is CH-3280 Murten.

Guarantee/Warranty
The seller grants a works guarantee on manufacturing defects of 1 year for professional use and 2 years for domestic use, from date of delivery. In the event of manufacturing defects, the buyer may claim repairs free of charge. Any further services are excluded. Wearing parts such as gaskets, Teflon tapes and welding wires and damage arising from wear and tear are excluded from the guarantee. Furthermore, damage caused by accident, transport, carelessness, improper use, dirt, calcification and other external effects is also excluded. Repairs must be carried out solely by the authorized specialist staff at the seller. Work carried out on the appliance by persons, other than those authorized by the seller, and the opening of the seal shall void any guarantee whatsoever. In order to clarify a guarantee claim the appliances are to be delivered at the buyer's costs to the seller or to an authorized partner firm. The transport and dispatch costs are in all cases excluded from the guarantee and shall be invoiced at the current rate.

Withdrawal from the sales contract
The provisions of the Swiss Code of Obligations govern any withdrawal from the contract. (Swiss Obligations Law) The seller's management reserves the right to withdraw from the contract, without stating reasons.
In all cases withdrawal must be declared in writing.

Right of revocation
Currently, there is no right of revocation in Switzerland.
As a goodwill gesture the seller will take back goods supplied within 14 days of date of invoice.
Pre-conditions for return:

  • The products must be returned in their undamaged original packaging.
  • The return of goods showing signs of having been used (such as lime, dirt, scratches, damage etc.) shall not be accepted.
  • Expendable items in opened original packaging shall not be accepted on grounds of hygiene.
  • The costs of return shall be borne by the buyer in all cases.
  • The buyer shall be liable for any reduced value of the goods and shall be obliged to pay an indemnification.
  • Used appliances (second-hand) and display models shall not be taken back.
  • Before returning goods, the buyer must contact the seller.

Data protection
The seller collects only the mandatory required data and uses these in the ordering process.
Personal data shall be treated in confidence; details shall not be passed to third parties.
